February 1, 2011 Careful planning is required for technology projects' contracts, based on appropriate legal advice.
The sound legal structure of technological projects of any kind is the basis of their success. Good planning begins in the pre-contractual phase: A clear establishment of the terms and conditions, a private invitation, adequate technical specifications and appropriate selection criteria. The contract must clearly specify milestones and phases of the project and the commitments for the parties as well as fines or constraints.
Finally, it should also establish mechanisms or anticipated unilateral termination and dispute resolution: mediation, technical, national or international arbitration. Legal advisors and technicians must work together to provide the appropriate project governance structures and thus ensure the project's success.
