March 15, 2011 Colombia is a country of laws and there is a firm belief in them and their social impact.
Currently, radical changes in laws are being prepared, which affect and foster compliance with legal order and have a deep impact in judicial and arbitration practice.
Under the aegis of Master Jairo Parra and the Colombian Institute of Procedural Law, the General Code of Procedure will be presented to Congress by the Interior Ministry. An aspiration and desire of several years released by law practitioners, who pursuit for a unification procedure. This reform updates rules for precautionary measures, streamlines processes and stimulates the parties’ activity. It also introduces specific rules for intellectual property and consumer rights, as well as facilitates the application of information technology to the procedure.
Recently, the State Council approved the Code of Administrative Procedure and Administrative Disputes, which modifies the relationship between governed individuals and the state, facilitating the use of the right to request and control of administrative acts.
Another ongoing reform is within national and international arbitration. The committee appointed for this purpose as Chair Universidad Externado de Colombia's rector, emeritus professor at the University of Paris, Fernando Hinestrosa, who will achieve a new vision of arbitration, probably with the UNCITRAL Model in mind.
Another commission, this time appointed by the Superintendence of Companies, aims to reform the system of guarantees for better access to credit for SMEs.
