On February 8, 2016, the Constitutional Court has passed a judgment prohibiting mining activities in wetlands thus declaring several articles of the National Development Plan law as against the Colombian Constitution.
The decision, passed with 6 votes in favor and 2 against, stated that all mining concessions that currently operate on wetlands must cease all mining activities. In this sense, the Court indicated that the right to a healthy environment prevails over rights acquired under environmental licenses.
