The right to privacy of consumers is protected

On July 10, the Congress of the Republic issued Law 2300/2023, which aims to establish the channels, hours, and frequency with which consumers may be contacted by entities supervised by the Financial Superintendency and all individuals and legal entities that carry out collection activities directly, through third parties, or by assignment of the obligation.

This law, colloquially known as the “stop bothering” law, seeks to protect consumers from untimely calls outside of working hours. The Financial Superintendency will authorize channels that will allow calls from financial institutions and their agents to be made in a respectful manner that does not interfere with privacy and family space. To this end, hours will be Monday through Friday from 7:00 a.m. to 7:00 p.m. and Saturdays from 8:00 a.m. to 3:00 p.m., excluding any type of contact with consumers on Sundays and holidays.

Entities that carry out collection procedures must refrain from asking the financial consumer the reason for the breach of obligation.
