The Superintendence of Corporations (SC) is now the entity in charge of supervising foreign non-profit organizations having an office in Colombia.

As we have previously reported, the Superintendence of Corporations (SC) is now the entity in charge of supervising foreign non-profit organizations having an office in Colombia.

As part of their supervision powers, the SC is in the process of issuing regulation regarding different aspects of those NGOs’ operation.

Several days ago, we reported the obligation to file Report 77 (i.e. financial and corporate information).

Now, we would like to draw clients’ attention to External Circular Letter 100-00004 of October 4, 2023 whereby the SC has established foreign non-profit organizations Colombian offices’ obligation to comply with anti-money laundering (SAGRILAFT) and anti-corruption (PTEE) rules by August 2024.

As we suspected, the SC is treating NGOs as if they were business entities, so we expect more similar regulation to come in the next few months. We will keep you posted.
